BITECHECK — TERMS OF SERVICE Last updated: May 2026 1. Acceptance of Terms By downloading, installing, or using the BiteCheck mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and BiteCheck (ABN: [YOUR ABN]) ("we", "us", or "our"). 2. Description of Service BiteCheck is a mobile application available on iOS and Android that helps users make informed food choices by: • Scanning product barcodes to retrieve nutritional information • Reading nutrition panel labels using AI-powered image recognition • Providing plain-English AI analysis based on your personal health goals • Tracking scan history and saving favourite products • Providing personalised nutrition insights and analytics 3. Not Medical or Dietary Advice IMPORTANT: The information, verdicts, insights, and analysis provided by BiteCheck are for informational purposes only and do not constitute medical advice, dietary advice, or any other professional health advice. BiteCheck is not a substitute for professional medical or nutritional guidance. Always consult a qualified healthcare professional or registered dietitian before making significant changes to your diet or if you have specific health conditions or dietary requirements. We accept no liability for any health decisions made based on information provided by the App. 4. Eligibility You must be at least 18 years of age to use BiteCheck. By using the App, you represent and warrant that you are 18 years of age or older. If you are under 18, you may not use the App. 5. User Accounts To access certain features of the App, you must create an account. You agree to: • Provide accurate and complete registration information • Maintain the security of your account credentials • Notify us immediately of any unauthorised use of your account • Accept responsibility for all activity that occurs under your account 6. Subscriptions and Payments 6.1 Free Tier BiteCheck offers a free tier with limited daily usage including barcode scans, nutrition panel scans, product comparisons, and saved products. Free tier users receive AI analysis powered by a standard AI model. 6.2 Pro Subscription BiteCheck Pro is available at the following prices (AUD): • Monthly: $4.99 AUD per month • Annual: $34.99 AUD per year 6.3 Billing and Cancellation All payments are processed by Apple App Store or Google Play Store. By subscribing, you agree to their respective payment terms. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You may cancel your subscription at any time through your Apple ID or Google account subscription settings. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial subscription periods. 6.4 Price Changes We reserve the right to change subscription prices at any time. We will provide reasonable notice of any price changes. Your continued use of the Pro subscription after a price change constitutes your acceptance of the new price. 7. AI-Powered Features BiteCheck uses artificial intelligence provided by Anthropic (Claude API) to analyse food product information. By using the scanning features, you consent to food label images and nutritional data being sent to Anthropic's API for processing. AI-generated analysis is provided on an "as is" basis and may not always be accurate. We do not guarantee the accuracy, completeness, or reliability of any AI-generated content. You may opt out of AI processing by not using the barcode and nutrition panel scanning features. 8. Prohibited Activities You agree not to: • Use the App for any unlawful purpose or in violation of any applicable laws • Attempt to reverse engineer, decompile, or disassemble the App • Use automated tools to scrape, extract, or collect data from the App • Attempt to gain unauthorised access to any systems or networks connected to the App • Interfere with or disrupt the integrity or performance of the App • Use the App in any way that could damage, disable, or impair the App or its servers 9. Intellectual Property The App, including its design, features, content, and underlying technology, is owned by BiteCheck and protected by Australian and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial purposes in accordance with these Terms. Your scan history and saved product data belong to you. 10. Privacy Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection and use of your information as described in our Privacy Policy. 11. Disclaimers and Limitation of Liability THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BITECHECK DISCLAIMS ALL WARRANTIES INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. IN NO EVENT SHALL BITECHECK BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO BITECHECK IN THE SIX (6) MONTHS PRECEDING THE CLAIM. 12. Dispute Resolution In the event of any dispute arising out of or relating to these Terms or the App, the parties agree to first attempt to resolve the dispute through informal negotiations by contacting us at hellobitecheck@gmail.com. If the dispute is not resolved within 30 days, either party may initiate binding arbitration in Melbourne, Australia, conducted in English by a single arbitrator. These Terms are governed by the laws of Australia. 13. Termination We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. You may delete your account at any time through the Profile tab in the App. Upon termination, your right to use the App ceases immediately and your data will be deleted in accordance with our Privacy Policy. 14. Changes to These Terms We may update these Terms from time to time. We will notify you of any material changes by email or through a notice in the App. Your continued use of the App after the effective date of the updated Terms constitutes your acceptance of the changes. 15.
